Driving while impaired, or driving under the influence (DUI), involves operating any motor vehicle while under the influence of alcohol or controlled substances. To reach second-degree charges, you must meet one of the following:
- A third DWI in ten years
- A second DWI in 10 years, compounded by a chemical test refusal or other aggravating factor
- A first DWI, compounded by two aggravating factors
Aggravating factors include:
- A previous conviction within the past 10 years
- A BAC of .20 or more
- The presence of a child under 16 years of age in the motor vehicle
