What not to do when falsely accused of sexual assault

On Behalf of | Jun 28, 2023 | Felonies

A sexual assault allegation, even when false, usually has far-reaching consequences. It can ruin your reputation and endanger your livelihood. If the prosecution convinces the court that you are guilty, you will likely face jail time and severe penalties.

Such an accusation can put you in a precarious position where one wrong move will likely worsen things. For this reason, it is critical that you avoid committing the following mistakes:

Contacting the accuser

Trying to talk the matter out with your accuser might do more harm than good. Chances are they already have a protection order in place, and talking to them might violate this order and put you in more trouble.

Explaining your side to the police

You might think speaking to the police openly about the accusation will help, but that is not always the case. The more you talk, the greater the likelihood of you providing potentially self-incriminating information. It is usually more helpful to heed the Miranda warning and avoid saying anything unnecessary.

Not cooperating

Ignoring the legal process is not likely to benefit you either, as it might make you appear more suspicious. It is generally safer to appear before the court as needed, submit court-ordered requirements and be on your best behavior.

Posting on social media

You might find it tempting to defend yourself on social media, but doing so increases your risk of giving away self-incriminating information. The prosecution can use some of your posts as ammunition against you in court.

Sexual assault allegations are serious, so you cannot afford to make mistakes. A criminal defense attorney can guide you in avoiding pitfalls that might worsen your situation. Most importantly, they can also help you defend your legal rights and fight to clear your name before the court.
