Driving while impaired, or driving under the influence (DUI), involves operating any motor vehicle while under the influence of alcohol or controlled substances. To reach second-degree charges, you must meet one of the following:

  • A third DWI in 20 years
  • A second DWI in 10 years, compounded by a chemical test refusal or other aggravating factors
  • A first DWI, compounded by two aggravating factors

Aggravating factors include:

  • A previous conviction within the past 10 years
  • A blood alcohol content (BAC) of .16 or more
  • The presence of a child under 16 years of age in the motor vehicle
